Just my opinion, but First Things has moved from being conservative to being reactionary. There is a difference.
Ken Graves will lose because the Appeal Court will uphold the decision and SCOTUS will deny cert.
Here is are 2 SCOTUS cases that show why he will lose:
1) Compagnie Francaise de Navigation a Vapeur v. Louisiana Board of Health, 186 U.S. 380 (1902)
2) Jacobson v. Massachusetts, 197 U.S. 11 (1905)

I agree with Duane. First Things had a noble and respectable history, especially when Richard John Neuhaus was at the helm. Sure he was a neoconservative, but his writings were pretty calm and reasonable compared with the current bunch of idiots.
Unfortunately in this current political day and social media age, the idiots rise to prominence and end up running the asylum.
