Immigration Forecast
Obviously the election will have direct impacts on immigration and will impact my clients. I can say this definitively because I experienced the impacts first hand in round one of Trump and I understand the implications of what he is saying he will do now.
Trump will not be able to do everything he claims. But he doesn’t have to to have a massive impact. And keep in mind a couple things
1. Immigration is actually THE one thing he cares about. I don’t think Trump cares that much about governing in general. But he is absolutely passionate about immigration changes and enforcement.
2. Stephen Miller, who is Trump’s right hand man on immigration, does know immigration and the system. He knows what levers to pull and where to throw sand in gears. And he learned from round one. I expect him to use his intimate knowledge of the system plus what he learned about where he was stymied to be very aggressive.
There is no doubt things are going to get much worse. I am not sure how that will impact those already in the pipeline. I currently have about 60 cases scheduled for trial over the next year. Not all of those will proceed, and the Court is constantly rescheduling. And based on the docketing system, it is almost impossible to finish a case in one hearing. So I already have plenty of work.
But that work is going to get harder. The willingness of government counsel to work with you and to offer to be more reasonable is directly a function of the imperatives they get from above. In Round one, Trump instructed OPLA to refuse to dismiss any cases. We also saw that basic communication lines were essentially cut off. The government attorneys (OPLA) are a mix of reasonable to impossible. But under Trump, everybody hardened and so every trial is likely to become a fight to the death over every single thing, even things that should not be in contest.
I don’t know how the flow of new clients will change under Trump. He is vowing to shut down the border, in which case very few may come in to the interior. It’s hard to know exactly because Trump used the Pandemic as an excuse to shut everything down. I suspect he intends to do the same, just not bother with using the Pandemic as the excuse.
If Trump ramps up Interior Enforcement, there will be massive dislocation and turmoil. The system as currently constituted really does not have the capacity for handling millions more deportation cases. And it will require massive resources. We are talking hundreds of billions a year. But yesterday Trump acknowledged there is no price tag. So in his mind, it does not matter how much it costs. The question is whether Congress thinks there is a price tag. But if I’m a Republican in Congress, and Trump asks me for 300 Billion to enforce immigration, I’m thinking that if I say no, Trump will recruit somebody in my district to primary me and Trump will tell my district that I stood in his way.
But they may not even put people in proceedings. They may try to do what is known as Expedited Removal, in which case the person never sees a judge. Currently ER is only applicable within 100 miles of the border, which still encompasses the vast majority of the country’s population. So he does not need to make a single change policy wise. All he has to do is say, enforce ER vigorously. Just as an example, in Ohio, that’s basically the entire northern half of the state. Technically, the law itself does not have a geographical limit. It’s just been policy. So Trump could simply say, enforce the law, everywhere, vigorously.
Just so you know, a person subject to Expedited Removal has to prove to the ICE Officer’s satisfaction that they are not a recent arrival and have been in the U.S. for two years. There is no hearing, and it’s entirely up to the Officer’s discretion whether he is satisfied. There is no appeal. The only way you get to a judge is if the person expresses a fear of returning to their country and wants to seek asylum.
If I were advising Trump, I would say you need to do massive enforcement and everybody you catch ship them to west Texas. Put them in tents and process there. Anybody that can’t prove they have been in the United States long enough to avoid ER, put them on a plane within days. Those who manage to prove their presence, or want to ask for asylum, put them in Court. And make personal attendance by counsel mandatory. The fact that they are 500 miles away from the closest immigration lawyer, well, that’s just sad isn’t it. And schedule the hearings within weeks.
Now, they may not do the last paragraph. But if they go vigorous on ER, it’s not going to be pretty.
Trump says first priority will be going after criminals. (Already the policy). The problem is that last time he basically said that everyone was the priority. If they actually narrowed the priority to criminals, ironically, he would be going the same policy as Biden. But based on round one, it’s not going to be limited to just criminals.
Other things- Refugee Resettlement is dead. Trump hates refugees.
As for legal immigration. There will be some, but it’s going to be much more difficult and a lot slower. The first round they put in lots of changes to make it really hard to legally immigrate. They will do that again, only more so. And allowing legal immigrants in is going to be super low priority.
You don’t need permission to share. Attribution is nice though.
Seeing Stephen Miller talk about the push to denaturalize citizens and deport the.m is terrifying. I can’t believe they could actually go that far… but they might.
That’s the thing that gets me, Michael. People are chomping at the bit to see this happen in real time.
I don’t buy this notion that people were entirely unaware of his policies, and will be shocked when they are enacted. No. People listened to his long winded speeches and got excited about what he had to say. They voted for his impending carnage with jubilation.
Again, I believe this is what more than half of America wants. I agree with “the end of the country as we know it.” Just can’t emphasize enough, people sat through his nonsense ramblings and loved it.
Those of us expecting ‘carnage” could be wrong, but my belief isn’t grounded in simple speculation.
Deporting millions of undocumented people will first have a devastating effect on these families.
I do not look upon these folks based on their national origin, but as humans made in the image of Christ.
What we will find if they are all successfully removed is how much the service economy relied on them to exist…and the constructions trades and agriculture as well.
We don’t know what inflation really looks like yet…Social Security could collapse by 2030…but that won’t bother some if we are to believe what they have previously said.
Then we will also see what happens when you dump massive amounts of people into countries that have already proven unable to support them…we could see a historic level of instability that opens opportunities for our enemies to exploit.
Many of them will die from violence or trafficking.
This will potentially leave a scar the size of the aftermath of the Civil War.
The giving over of Ukraine will embolden a tyrant…history tells us that once emboldened, tyrants are never satisfied with their gains.
As to whether we have carnage today…we have an economy that came through Covid stronger than any in the world…quite a feat.
All economic indicators are positive…prices have not receded enough, but the rate of inflation has been substantially cooled.
We have problems…but we shall see if there are real solutions that don’t destroy that which we want to preserve.
Didn’t expect the pivot to Ukraine. Once again the tyrant was at bay until Biden gave him unrivaled access. As for abandoning Ukraine; I doubt that. But Europe has to step up and no one is going to dislodge Putin from the Donbas at this point. It will be land for truce. Unless we push into WW III which may be upon us already.
Economy? Yes it is strong but Biden caused inflation with his executive action on oil. His Inflation Reduction Act was exactly the opposite. Americans feel the pain of inflation and immigration and they punished the Dems for it. They obviously want Trump to close the border.
And geeze the Dems give us Kamala? The least serious candidate for president in history. She was clueless and never answered a single question that didn’t end in abortion or DT phobia. She was vacuous. And what a mockery of the process itself. It was demagoguery not democracy.
The sweeping choice of Trump all by itself shows what mess she was.
Time will tell if the removal of immigrants and the imposition of tariffs makes all things better or if the economy is devastated with low income and middle class America bearing the brunt.
Closing the border to humans is possible at great expense economically…but the real bad guys and the drugs will come unabated by walls and rhetoric.
Perhaps we will find that our real problems weren’t caused by strangers…perhaps.
Just as many conservatives are not entirely thrilled with Mr. Trump as a person, I don’t think most liberals are thrilled with Kamala as a person either. They are both standard bearers for a list of issues. For those who want to see the first female president, she must have been a disappointment. Even Hilary had more going for her than poor Kamala.
So I see Trump as a symbol against the ridiculous woke-world where we can get fired for referring to a man in drag as “he,” and where tampons are put in men’s restrooms. A hundred issues like this that eat away at decent people every time they leave the house or turn on the TV. Every movie is dominated by a “strong female lead,” every parent has to be alert that their child’s teacher isn’t secretly leading them into the trans world. Regular normal people just had ENOUGH.
Now I remember the first Trump presidency. Remember “We will build a wall and Mexico will pay for it?” Never happened. I don’t think half of what Trump has campaigned on will happen, just like the first time.
Here’s what I think about immigration:
– Close the border entirely for a period of time. If we stop sending all our tax money overseas we can manage this. (There must be exceptions for people traveling to work, etc.)
– Send immigrants who are criminals back to their homelands.
– Leave everyone else alone.
– Eventually re-open the boarder but observe check-point procedures. Put a wall everywhere else.
-No more settling huge numbers of immigrants into small rural towns and overwhelming the local people and services. This will make people hate the gov’t like nobody’s business.
I don’t think Trump will get very far with just rounding up innocent people and sending them back to wherever they originated.
As I always say, if you are concerned about loving the stranger look around and find some strangers to love in your own town. Easy to love the stranger on the boarder; not so convenient to love the stranger on your street. But I believe that is the true meaning of loving one’s neighbor.
If we are relying of the services of under-paid illegal immigrants and our economy will collapse if they depart we are practically endorsing a form of slavery. We have formed an underclass of scared people who barely get paid enough to survive.
I have heard this sentiment over and over again…but doubt that a completely immoral man will change it much.

Mexico is one of Americas largest trade partners and many American companies built factories on the border to take advantage of low labor costs.

This appointment would mark a watershed moment for both national health and liberty. For those of us who are interested in the food system (which BTW is slowly killing us), this would be a giant step in the right direction.

Officials and universities in a growing number of U.S. states are condemning racist text messages that were sent to Black residents this week. The messages, which began appearing Wednesday, were received by people in at least 32 states and the District of Columbia, CBS News has found.
There were a number of variations of the messages using similar language, telling the recipient they had been “selected for cotton picking” or to become “a slave.” All of the texts included instructions, times and dates to “be ready” and references to being picked up in a van. Some included the recipient’s name or general location, according to people who received the texts and screenshots reviewed by CBS News.
I’d really like a deep dive analysis on the drop in votes between 2020 and 2024. In Santa Clara County (CA, mostly Silicon Valley), it was -281k. At the top of the ticket, both parties lost votes, but the Dems far more.
The San Joee City Council opened a session this year with a drag queen performance. This week, one of the Latino Council members was arrested on pedophile charges. Local people have lost faith in our Brown leaders. We’re mostly Mexican here, and they are RCC, small c conservative. One of my contractors, Chicano, grew up in Calexico and has relatives in MX. He does not like illegal immigration, nor this administration settling and paying for what he views as too many immigrants. Right or wrong, that is how he feels. The Democratic party made a huge miscalculation by not listening to their constituents.
Much like The Wall, I also don’t think there will be mass deportation. Whatever the case, it will not happen in Cali.

If what we all fear comes upon us, it will lead to either a moral and intellectual revival or the end of the country as we know it.
Unfortunately, the human cost will be significant either way.
